4. Terms used

"Personal data"

...means any information relating to an identified or identifiable natural person. An identifiable natural person is a person who can be directly or indirectly associated with a name, identification number, location data or online identification (for example cookies). It can also be identified by reference to characteristics which reflect the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person.

“Processing"

.... means any operation or set of operations carried out with or without the aid of automated processes concerning personal data. The term is broad and covers virtually all data handling.

"Responsible person"

... means the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data.

5. Types of data processed:

The following data are processed:

  • IP address of the requesting device
  • Date of request
  • first line of the request
  • technical status of the request for processing (successful, prohibited, unknown file, etc.)
  • number of bytes returned by the server (data volume)
  • so-called "referrer" sent by the requesting device
  • so-called "user agent" sent by the requesting device

6. Purpose of data processing

The data processing serves the following purposes:

  • Provision of the online offer, its function and contents
  • Responding to contact requests and communication with users
  • Security measures

7. Rights of persons concerned

You have the right,

  • to request confirmation as to whether or not data in question are being processed and to obtain information on such data and further information and a copy of the data (Art. 15 DPA).
  • to request the completion of data concerning them or the correction of incorrect data concerning them (Art. 16 DPA).
  • to demand that data concerning you be deleted without delay (Art. 17 DSGVO) or, alternatively, that the processing of the data be restricted (Art. 18 DSGVO).
  • to receive the data concerned (which you have provided) in a structured, common and machine-readable format. In addition, you may request that these data be transmitted to other responsible parties (Art. 20 DSGVO).
  • submit a complaint about the processing of your personal data by us to the competent supervisory authority (Landesbeauftragte für Datenschutz und Informationsfreiheit des Landes Nordrhein-Westfalen/www.ldi.de) (Art. 77 DSGVO).

8. Right of withdrawal

You have the right to revoke consents granted in accordance with Art. 7 Para. 3 DSGVO with effect for the future.

9. Right of objection

You can object to the future processing of data concerning you at any time in accordance with Art. 21 DSGVO.

10. Use of cookies

“Cookies" are small text files that are stored on your computer and saved by your browser. These serve to make the offer usable and more user-friendly.

However, no cookies are used on the publicly accessible DHPol website.

A cookie is only set after a login. This is a technically necessary cookie to manage the session created during login.

You can prevent the use of cookies by setting your internet browser so that it does not accept cookies. You can also specify in your browser whether you wish to be informed about the setting of cookies and only allow cookies in individual cases. You can also exclude the acceptance of cookies for certain cases or even generally. Furthermore, you can activate the automatic deletion of cookies when closing the browser.

11. Web analysis

We use Matomo (formerly Piwik), an open source software for statistical evaluation of user access and we do not use cookies here. The IP address is anonymised immediately after processing and before it is saved. We only evaluate the stored data for statistical purposes, for example to be able to recognise faulty links or to optimise contents. The data collected for this purpose will not be passed on to third parties. Data processing for the purpose of evaluation is carried out in accordance with Art. 6 Para. 1 S.1 lit. f DSGVO and cannot be traced back to individual visitors. With regard to the processing of personal data, we try to operate these pages as data-efficiently as possible. There is no active content from social networks on these pages.

12. Protocol or log files

Whenever the contents of the website are accessed, data is temporarily stored there via so-called protocol or log files, which may allow identification.

The following data is collected each time the website is accessed:

  • IP address of the requesting device
  • Date of request
  • first line of the request
  • technical status of the request for processing (successful, prohibited, unknown file, etc.)
  • number of bytes returned by the server (data volume)

These data from the protocol and/or log files are used to defend against and analyse attacks and are stored for seven days directly on the server and are only accessible to administrators. After that, they are only available indirectly via the reconstruction of backups in hard disk arrays and are finally deleted after 30 days.

13. Making contact

When contacting (for example) by e-mail, the user's details are processed for the purpose of handling the contact request and its processing in accordance with Art. 6 Para. 1 lit. b. In doing so, the entry of personal data by the person contacting the user is on a voluntary basis.

Requests, e.g. by e-mail, can be saved:

  • Name, First name
  • Email address
  • Street, house number, postcode, town
  • Phone number
  • Subject
  • Your message text
  • Timestamp
  • User
  • IP address

When you contact us by e-mail, the data you provide voluntarily must be stored so that we can process your request.

Persons under the age of 16 should not send us any personal data unless the consent of their parents or guardians (holders of parental responsibility) has been given (Art. 8 Paragraph 1 DSGVO). The consent must then be expressly noted in the message (Art. 8 Paragraph 2 DSGVO). We do not request personal data from children and young people. We do not knowingly collect such data.

We use the personal data you enter only for the purpose you have requested and only within DHPol or the authorities, departments and institutions commissioned with the respective service.

We will delete the personal data we receive by e-mail as soon as storage is no longer required for the purpose you have requested or in connection with associated administrative processes and the storage obligations applicable to them.

14. Transfer of personal data

Data that is logged when accessing the website or collected for a special service will only be transferred to third parties outside DHPol if required by law, court or public prosecutor's orders or if the transfer is necessary for legal or criminal prosecution in the event of attacks on the state government's Internet infrastructure.
